Laws and morality often conflict. The US is currently attacking foreign citizens outside the United States without due process. Israel has multiple government members currently with warrants for arrest for genocide. Just because something is legal or illegal doesn't make it right.
When has military action every used due process?
If you don't agree that the military should be used against suspected narco-terorrists, then say that.
But they kill about 70000 Americans a year just with Fentanyl overdoses. I don't think killing 70 narco-terrorists (so far) is much of an escalation.
