#46Entirely different question is does offering a tool for this process constitute as fair use as well. Specially if there is DRM involved. Or does tool need to work in specific way to qualify? For example you could record video on your own machine while watching it, but could not directly download a copy?

Yes. By design. Copyright law, and basically all other IP law, is explicitly and purposefully about allowing rent seeking. The idea is that in a completely unregulated market, it is impossible to make money from ideas after they are made public. There was no copy protection being bypassed in that era, and ripping CDs was just a normal thing that people did to listen to music on their computer without having to worry about scratch discs etc.
