My company has a H-1B guy that travelled home to India a few months ago and since then can't come back because the next date he can get with the US embassy is next year. Seems he may get stuck even longer... I am to some degree on board with keeping a closer eye on immigration, but the way the current administration does it feels intentionally cruel. The guy at my company has a house, wife, and kids in the US; his vi…

"feels intentionally cruel" They are intentionally cruel. Its the point. They aren't even trying to hide it. The posts on official Whitehouse X account are borderline gleeful on topics of deportation and immigration. I'm in dis-belief at times.

when you treat immigrants like they were not people with lifes, you are just one step away from treating poor people as they were not people and then too treat all common people as they were not people. also it has been quite convenient explanation for adopting systems such as Flock and allowing all kinds of para-police actions which seems very similar to what happened in germany circla 1930-1934

oh please, everyone knows that its referring to their immigration status or legality of stay in country.

you surely must realize that any rational person just shrugs off listening to what else you might say when you start with such ridiculous interpretations

So for those that don't know, it's quite common for a visa renewal to be required to leave the country. Depending on the visa, you might have to do this every year. So just imagine, having a normal job in the US and you're asked to leave to renew your visa and this stuff happens. That's no more appointment, not even a new date and you're now very likely unable to work and possibly can't even enter the country to get…

This is for immigrant visa, not work visa. I think you got it all wrong.

I think you have a point, however a change of status for example (so from temporary to permanent) can require you leaving the country.

Also, the first paragraph of the article says it too:

"Immigrant visa applicants with interviews scheduled at U.S. embassies and consulates have been notified by email that their appointments are being postponed."

I'm an American that lives abroad. I have first-hand experience how other countries treat 'immigrants'. H1B is a temporary non-immigrant visa. I could never imagine myself buying a home in a country where I don't have permanent access to that real estate. I am not opposed to voting to prevent non-PRs from owning real estate in order to keep housing prices lower for residents and prevent non-immigrants from shooting t…

This comment vaguely blames immigrants for not having an escape plan. Millions of people immigrate to the US through all the right mechanisms and follow all the laws and have every intention of staying forever and becoming citizens. Scaring their pants off is an unnecessarily hostile and unwelcoming act that is unbecoming of this country. > in order to keep housing prices lower for residents And where do they live? T…

But titzer, are you not a wealthy resident as well? I thought we were among friends!

That term has been in use for at least the half century I’ve been alive. It’s a common word almost every where in the US, shows up in daily conversations, but it’s been deemed not politically correct. That’s why you maybe never heard it in media or from a politician in the past. This presidency is all about breaking political correctness though and it’s on brand. This is why his devotees love him. Simple things like saying the words we were told we couldn’t say really resonates with some people. There’s unfortunately still a lot of deep seated racism in the US. Will take a thousand more years to really get rid of it. Political correctness is a way to force accelerated the process, it backfires when you push it too hard too fast. You’re trying to change culture faster than humans can be expected to change (pesky long lifespans and all). It doesn’t work well and cause a pressure cooker situation. Trump is the steam venting of years of political correctness and rapid progressive movement.

I'm guessing that you did not actually read his dissent. Far from agreeing with the Trump administration; his view would effectively end birth tourism but preserve birthright citizenship (and maybe even stronger) for the children of non-citizens, legal or otherwise, who are domiciled in the US. As for it being cut and dry, do you earnestly believe that "and subject to its jurisdiction" is cut and dry? You might have…

Subject to its jurisdiction is pretty cleanly meant to mean paying taxes and obeying laws enforced upon them, which I concede could mean one is subject to multiple jurisdictions but it is not necessary to be subject to only one.

"Paying taxes" cannot be an important part of this. At the time this amendment was passed, income taxes not only did not exist, but were also unconstitutional.

The leaving part is not the issue, as you try to immigrate into a country you're subject to the rules that country sets. You're always free to not immigrate into that country (this is not about asylum). The issue here is that, if you just left the country to do everything the country asked you, you are now in limbo. For how long? No one can tell. Does this mean you lose your job? Maybe. And when you decide it's no lo…

You treat them like they are people without personal agency.

Temporary worker programs are a deal offered on open terms: people can come to work, but they have to leave afterward. The laws are plastered with the word “temporary.” People take advantage of the deal knowing the terms and there is nothing wrong holding people to the deal.

Especially when they arbitrarily change the rules so people who did everything by the book are now “illegals”. Especially when they “lose” paperwork somewhere inside of an enormous overworked and hostile bureaucracy.

it’s a cut and dry constitutional amendment, it doesn’t matter if Thomas thinks the people that were in mind when it was drafted are not the same people it applies to now. if they want to change it, go ahead and get the states to ratify a new amendment. Supreme Court doesn’t get to throw out an amendment because it’s old.

It's also amusing that you won't ever hear conservatives like Thomas making the same argument when it comes to, say, the 2nd amendment.

You also won't find Thomas making this argument for birthright citizenship because he didn't make that argument for birthright citizenship. The post you are replying to is incorrect, this was not his argument.
