The behaviour in a vacuum might not be so bad but she was consciously trying to test how far she could go before they broke a law made specifically due to anti-abortion protesters like her intimidating woman to the point they wouldn't use the services.

Sadly, other political bodies do this as well, and it is becoming more common. That clause, I agree, was a mistake. Still, the charter has at least been beneficial in many court cases, and caused many laws to be turfed (many of which, are just dropped forever).

TBH, I think the conduct of the cops is fine here. If someone alleges that the other party is making death threats, I want them to investigate. It's not alleged that the cops mistreated Mr. Epstein. If all the police did was investigate, then their conduct would have been fine. But they arrested him, and that is not adequate conduct.

The first amendment to the US constitution does not apply to Canada. Unless you believe US law is globally binding. (That said, Canada does have their own freedom of speech, under the Charter of Rights and Freedoms.)
