It says "will seek to open source technology for the public benefit when applicable" they have open sourced a number of things, Whisper most notably. Nothing about that is a promise to open source everything and they just need to say it wasn't applicable for ChatGPT or DallE because of safety.

I doubt the safety argument will hold up in court. Anything safe enough to allow Microsoft or others access too would be safe enough to release publicly. Our AI overlords are not going to respect an NDA. And for the public safety/disinformation side of things, I think it is safe to say that cat is out of the bag and chasing the horse that has bolted.

In what capacity is Musk suing OpenAI? Musk may have co-founded the company, but then he left (to avoid any potential future conflict of interest with his role as CEO of Tesla, as Tesla was increasingly becoming an AI-intensive company). Is he a shareholder, if not what gives him any say in the future of the company?

The "when applicable" is ambiguous, but IANAL. Does it become applicable to open source when "The resulting technology will benefit the public"? That seems the clearest read. If so, OpenAI would have to argue that open sourcing their models wouldn't benefit the public, which... seems difficult. They'd essentially have to argue that the public paying OpenAI to use an OpenAI-controlled model is more beneficial. Or does…

The "when applicable" is like the preamble to the Constitution. It may be useful for interpreting the rest of the Articles of Incorporation but does not itself have any legal value.

After all, the AOI doesn't specify who determines "when applicable," or how "when applicable" is determined, or even when "when applicable" is determined. Without any of those, "when applicable" is a functionally meaningless phrase, intended to mollify unsavvy investors like Musk without constraining or binding the entity in any way.

Exactly. That's the problem. There needs to be more to make "when applicable" mean something, and the lawyers drafting the agreement deliberately left that out because it's not intended to mean anything.

He seems to broadly pursue projects he considers helpful to humanity like sustainable energy, the multiplanetary thing and setting up OpenAI. You can interpret people's motivations in different ways but it doesn't look like just power gathering to me. I mean if he was that power hungry you'd expect him to try to monopolize AI for himself rather than make it open.

How does manipulating MemeCoin prices or buying Twitter to bring back the n-word benefit humanity?

While the broad strokes of Tesla and SpaceX might benefit humanity, he seems to have no compunction about doing screwed up things with those companies, either. Remember when he proposed putting indentured servants on Mars?

Sour grapes. This is a power move. Elon wants to be the sole savior of humanity who just so happens to have more power than anyone in history. No coincidence this came out soon after OpenAI announced its partnership with Figure, making them a direct competitor to Tesla Optimus + Xai.

How did you come to this idiotic conclusion after reading the article? Elon Musk cofounded OpenAI as a non-profit organization in 2015 and provided the majority of funding until 2020. It wouldn't exist without his funding. Sam Altman lied and now GPT-4 is closed source and is controlled by Microsoft. How does that benefit humanity? Companies can change from the outset. if they didnt become closed source they couldn't have gotten funding to get the GPU hours needed for GPT-4 or the best talent. If Elon cared about humanity he would open source Grok and Optimus. in fact he only left OpenAI because he wanted to take over to integrate it into Tesla but failed.

Page 37 of the lawsuit has the certificate of incorporation. It says precisely what Musk claims it says. That’s the founding document he’s referencing.

No idea, don’t know what they stand for. This is logic. What do you do if you’re Sam Altman and ChatGPT has blown up like it has, and demands resources just to run the GPU’s. What is his next move? It’s not business as usual.

The risk is that he’s too confident and screws it up. Or continues on the growth path and becomes the person everyone seems to accuse him of being. But I think he’s not interested in petty shit, scratching around for a few bucks. Why, when you can (try) save the world.

There is no reliable evidence that AGI is an existential threat, nor that it is even achievable within our lifetimes. Current OpenAI products are useful and technically impressive but no one has shown that they represent steps towards a true AGI.
