You’re also being empathetic and respectful to the man while crediting his legacy and all the work he has done in his past. I wonder if the people objecting to your statement would object as strenuously had you had phrased it as “evidently mentally unwell”. The word “ill” seems to have triggered people into reading more into it…

This is a reasonable hair to split, I agree with you and I think it might have gone differently (though "mentally" itself will trigger people, and there is a lot of certainty that he must be a particular arsehole simply because of the history of WordPress, or Gutenberg, or whatever it was that coloured their judgement).

They clearly changed their mind. That "no longer developed" note is from September 2025. They made a bunch of non-trivial improvements in 2026: https://simplenote.com/blog/

These appear to be a sort of AI-driven re-evaluation.

I am a sort of engaged cynic about AI but I am happy to chalk this one up as a straightforward win for the machines.

(I'm also quite intrigued about the other blog post regarding an MCP for Simplenote — I love the idea of an LLM's knowledge-base being accessible in such an instantaneous way)

Anyone could have forked WordPress at any time or spun up their own multi tenant instances if they were truly concerned, this just seems personal. It’s a bad day for founders IMO.

And the part that is being litigated is whether that is, in fact, fair use, correct? I like the comparison to Chrome and Chromium. I don't know the timeline of the whole wordpress IP. At this most it has arguably undergone genericization. That's why I think it's complicated enough that there is merit to arguments on either side.

That's a small part of what's being litigated. The rest of what's being litigated is unfair trade practices, monopolization, promissory estoppel, defamation, and computer fraud/abuse.
