I think the issue is the ToU violation, not copyright.

Don't terms of use depend entirely on copyright to work? Without copyright ... why would you need to agree to terms of use to use the software/site/data?

And doesn't that mean that terms of use can never impose restrictions stricter than copyright?

We are entering a Kafkaesque world where all powerful companies are the gatekeepers, but there is no chance to talk to a human to appeal their decisions. Your only hope is if a) you have an inside contact or b) you can create enough stink on social media.

We will soon use ChatGPT Astra to talk though shit to get out problem solved.

If we lived in a sane world, people would simply pay for what they use. Then we could avoid all this confusion, and google would have large (monetary) incentive to protect it's customers.

Google and Meta are entirely within their rights to make YouTube, Search, Facebook and Instagram into paid services for all users. Nobody is forcing them to advertise or to participate in criminal fraud with scam ads.

They are heading pretty steadfastly into multi billion dollar lawsuits the way they are going.
