Defiance of the rules? What rules exactly? The law does make clear that H1-Bs are temporary workers. But it's also permitted to renew, and workers are allowed to pursue immigrant status. In fact, until 1990 there was specific language saying that H1-B's (like all visitor visas) are not supposed to want to stay, they must maintain a foreign residence "which he has no intention of abandoning". This language was struck…
> This language was struck and the visas became, and still are, the most common defacto "seeking green card" status for workers seeking to move the US. Incorrect. H1B still requires non-immigrant intent. The only thing that was struck was requiring the government to presume non-immigrant intent automatically upon some filing for permanent residency. That was not intended to change the system into a de facto permanent…

It's not a mobster way, more like a weasel way. The reason it is a weasel's move is because decisions at the consulate are made by consular officers who are career public workers and won't deny visas for arbitrary reasons. That is bad for the political leadership because they just don't want to issue visas. So they need to invent evasive moves to throttle the pipeline by adding trainings, background checks, and other…

Visa can be denied for arbitrary reasons based on what executive branch of US. there have been multiple cases where it has been clear that visas are a privilige not a right. Visa needs a reason to be granted, by default it is denied.

The country wants you to leave and then get’s to decide if you can come back. That’s how it’s designed. On purpose. You’re approaching it from a perspective where you’re being asked to leave and your reentry is a right. It’s not. They never said,…

That is how it's designed, and that's fine. But make a decision... They're pausing the decision making for an indefinite amount of time. That's not how it was designed, but it sure does look like that's on purpose.

> That’s how it’s designed. On purpose. The cruelty is the point. (The UK system requires initial applications from overseas but I believe doesn't require you to leave for renewals)
Not at the moment, but the result of the current UK system has been huge uncontrolled levels of immigration leading to deep public resentment, so that may change in the future
From my perspective as an immigrant in the UK, there have got to be so many parameters the UK government can adjust before indulging into performative cruelty. Setting higher requirements for visas, revising what jobs qualify for Skilled Worker visas and such. In fact, my understanding is that this is exactly what they have been doing (rather mildly), and it's been successful.

I find the idea the only immigrants can do low skill labor kinda… obtuse. Maybe Americans should pick their own crops instead of living in a delusion that certain labor is beneath them. Boomer era “all my kids are going to get white collar jobs” type thinking isn’t sustainable.
I’d only say change the system to provide a pathway to residency. If you’re willing to work 12 hour days to ensure my fat American born self keeps eating , you deserve a spot here. One of my former partners was making around 200k. Her grandparents cleaned homes. The idea is that you come here and your life is crappy low paid work, but your kids and their kids have amazing careers.

#836So for those that don't know, it's quite common for a visa renewal to be required to leave the country. Depending on the visa, you might have to do this every year. So just imagine, having a normal job in the US and you're asked to leave to renew your visa and this stuff happens. That's no more appointment, not even a new date and you're now very likely unable to work and possibly can't even enter the country to get…
You built stuff on a temporary foundation and now act surprised when said foundation is gone.

#837In my country, we do have a policy of integrating people quite early on if they come from a fragile situation and for other people if they have jobs and can sustain themselves it is a bonus as they contribute with taxes and will have basically no benefits like retirement.
I am not making any points here, I am trying to understand why people think this is a priority and/or problem.

Visa rules are country specific and don’t apply to the EU in general. There are countries that require you to leave.
Do you have any examples? I expected Schengen to have a common set of requirements regarding visas.

Get your stuff shipped home. Liquidate your assets. You built stuff on a temporary foundation and now act surprised when said foundation is gone.
Your comment is plain evil. No empathy, nothing.

Not trying to make a political point at all and perhaps a controversial take. But, it’s specifically and maybe implicitly by design. Meaning they made this way precisely so you have to reapply so they can change their mind or block you out later. Nothing about getting a visa is permanent and you’re fully at risk when you move here with that type of status. If you evaluate the situation that’s always been the case.
The leaving part is not the issue, as you try to immigrate into a country you're subject to the rules that country sets. You're always free to not immigrate into that country (this is not about asylum). The issue here is that, if you just left the country to do everything the country asked you, you are now in limbo. For how long? No one can tell. Does this mean you lose your job? Maybe. And when you decide it's no lo…
also it has been quite convenient explanation for adopting systems such as Flock and allowing all kinds of para-police actions which seems very similar to what happened in germany circla 1930-1934
