I didn’t follow your casino allegory. Anyway I happen to agree that “pausing” is inhumane. What I’m trying to communicate is we didn’t get here in a vacuum. There is a real problem and good faith attempts have been made to curtail it by putting pressure via “taxes” on the “interests of capital” abusing H1B. Cooperation would have prevented this.

Is an un-rigged and meritocratic system possible if there are border controls? If not, then using words like "rigged" and "meritocratic" as a complaint about the current system can only mean that you want no border controls. If so, how? Every system I can think of can be rigged, and exclude people who have merit, resulting in a system which favors the rich and powerful.

I disagree.

The cruelty is the point.

Like most internet meme phrases, this is both trite and inaccurate. The cruelty is not the point. This administration has decided foreigners are the scapegoat, and wants to get rid of as many as they can. It’s heartless, but cruelty is not the objective.

Yes cruelty is the point for this admin and its voters. They think it makes them more manly looking. They openly brag about it. They glee in it. They go out of their way to endanger goals just to be cruel.

All of that is in the open, if you listen to what they say and watch what they do.

It's not a mobster way, more like a weasel way. The reason it is a weasel's move is because decisions at the consulate are made by consular officers who are career public workers and won't deny visas for arbitrary reasons. That is bad for the political leadership because they just don't want to issue visas. So they need to invent evasive moves to throttle the pipeline by adding trainings, background checks, and other…

> The reason it is a weasel's move is because decisions at the consulate are made by consular officers who are career public workers and won't deny visas for arbitrary reasons. No? Visa can be denied for arbitrary reasons based on what executive branch of US. there have been multiple cases where it has been clear that visas are a privilige not a right. Visa needs a reason to be granted, by default it is denied.

No, you are confusing discretion with whims of the executive branch. Consular officers have discretion to adjudicate the applications and they can deny them for reasons prescribed in the INA. Those decisions are not reviewable. They are still supposed to follow their training, the FAM, and the INA in making the decisions. If Rubio sends an email to the consulates that says, "deny all visas", that would be illegal as a matter of policy and will be overturned by the courts under the APA. Note that 212(f) (aka Muslim ban from Trump v. Hawaii) gives discretion to the president to bar entry into the country, not visa adjudications. Visa adjudications require individualized determination by the consular officer.

So you agree with the person you're responding to, but you're attacking them for stating it with less melodrama than you would prefer? What a useless comment.

Unnecessarily euphemistic descriptions of cruelty should be rightfully called out

I agree. Please point to the one you're referring to.

I think what he's saying is if a corporation has a genuine need of some high specialist in a skill, and no American has that skill - then okay, such is life - bring in a foreign worker. But corporations have abused the system to unnecessarily employ immigrant labor in lieu of American, because immigrant workers not only tend to earn well below market wages (which is supposed to be illegal), but also tend to be far mo…

If true, that interpretation hardly seems relevant given that all immigrant visa applications are paused, with the goal of determining whether immigrants are likely to become dependent on public benefits in the US. It's not simply a pause on immigration by people applying for a category which requires special expertise.

I suggest you read up on how we got here.

OP is right. There are too many people here in the comments who act surprised although it has been very clear what the Trump administration is trying to do. The cruelty is the point and they are not even trying to hide it.

> There are too many people here in the comments who act surprised

That may be so, but since the person they're responding to is not one of them, I don't see the relevance of their comment.

> The moral issue is the same in both cases: there’s a big sign that says “temporary.” People have chosen to ignore the sign. No. Your analogy works well solely for the concept of temporary authorization. If you're offering up 2h parking as proof that the moral stakes are equivalent...

The moral issue is defined by the nature of the rule, not the stakes for someone who has transgressed. Enforcing the rule doesn’t become less legitimate just because someone has invested more in breaking it.

Which rules are being broken? It seems to me it is the State department that has suddenly and capriciously begun violating immigration law, rather than processing Visa applications according to the laws of this country. Is it because this administration knows it could never hope to pass a law this terrible?

So for those that don't know, it's quite common for a visa renewal to be required to leave the country. Depending on the visa, you might have to do this every year. So just imagine, having a normal job in the US and you're asked to leave to renew your visa and this stuff happens. That's no more appointment, not even a new date and you're now very likely unable to work and possibly can't even enter the country to get…

Or... one can move to place which treats you with respect you deserve, and not like some unwanted garbage scum.

Is this really how smart immigrants want to live their lives since this is not some temporary glitch? This is society you want to raise your kids in? There is no sum of money high enough for me to accept such treatment, money are not that relevant once person is not poor.

And if its not money, other places have much better working societies in all important metrics, not just this (healthcare, education, social services, criminality, infrastructure and so on... basic pillars not some nitpicks)
