It says "will seek to open source technology for the public benefit when applicable" they have open sourced a number of things, Whisper most notably. Nothing about that is a promise to open source everything and they just need to say it wasn't applicable for ChatGPT or DallE because of safety.

I doubt the safety argument will hold up in court. Anything safe enough to allow Microsoft or others access too would be safe enough to release publicly. Our AI overlords are not going to respect an NDA. And for the public safety/disinformation side of things, I think it is safe to say that cat is out of the bag and chasing the horse that has bolted.

If the above statement is the only “commitment” they’ve made to open-source, then that argument won’t need to be made in court. They just need to reference the vague language that basically leaves the door open to do anything they want.

I think that position would be a lot more defensible if they weren't giving another for-profit company access to it. And there is definitely a conflict of interest when not revealing the source gives them a competitive advantage in selling their product. There's also the question of if the source is too dangerous to make public, how can they be sure the final product is safe? An argument could be made it isn't safe.

It’s easy to defend this position.

It is safer to operate an AI in a centralized service, because if you discover dangerous capabilities you can turn it off or mitigate them.

If you open-weight the model, if dangerous capabilities are later discovered there is no way to put the genie back in the bottle; the weights are out there, anyone can use them.

This of course applies to both mundane harms (eg generating deepfake porn of famous people) or existential risks (eg power-seeking behavior).

It seems like he's talked a lot about the T in LGBTQ, not so much the G? Evidence that he would be especially incensed at getting beat by a gay guy seems thin on the ground unless we insist on treating LGBTQ as a bloc. (I don't exactly keep up with Musk's doings, though.)

There's that time, soon after he took over Twitter, when he boosted a right-wing conspiracy theory that Paul Pelosi was attacked by a male escort (https://apnews.com/article/2022-midterm-elections-elon-musk-...). (He later deleted the tweet without explanation.)

This kind of stuff matters when it's amplified to 100M+ people, and he knows it.

I put some of the blame for the Club Q nightclub shooting that happened a few weeks later (https://www.nbcnews.com/nbc-out/out-politics-and-policy/club...) on this kind of behavior. There's no evidence the shooter saw that tweet in particular, but his homophobia was clearly stoked by this sort of edgelord-ism on social media.

I’d offer that Musk hasnt shown any consistent principle motivating his behavior other than gathering power, in the face of stated motivations. He seems to broadly pursue projects he considers helpful to humanity like sustainable energy, the multiplanetary thing and setting up OpenAI. You can interpret people's motivations in different ways but it doesn't look like just power gathering to me. I mean if he was that power hungry you'd expect him to try to monopolize AI for himself rather than make it open.

That's right it doesn't exist so the facts on the ground are that he doesn't care about openness. And if he truly cared about humanity he would give away all of the designs, code etc for Tesla, SpaceX etc.

Wouldn't you have to prove damages in a lawsuit like this? What damages does Musk personally suffer if OpenAI has in fact broken their contract?

They scammed him out of tens of millions of dollars and a significant amount of his time and energy.

Sour grapes. This is a power move. Elon wants to be the sole savior of humanity who just so happens to have more power than anyone in history. No coincidence this came out soon after OpenAI announced its partnership with Figure, making them a direct competitor to Tesla Optimus + Xai.

How did you come to this idiotic conclusion after reading the article?

Elon Musk cofounded OpenAI as a non-profit organization in 2015 and provided the majority of funding until 2020. It wouldn't exist without his funding. Sam Altman lied and now GPT-4 is closed source and is controlled by Microsoft. How does that benefit humanity? OpenAI was meant to be open, sharing their research with all of humanity. Sam Altman is a fucking sociopath, a ruthless scammer. The lawsuit demands that OpenAI releases all of their research and technology to the public. Right now GPT-4 is only enriching Microsoft, the largest tech company on the planet.

Unless the charter leaves room for such a drastic pivot, I'm not sure how well this would hold up. Whether the original charter is binding is up for lawyers to debate, but as written it seems to spell out the mission clearly and with little wiggle room for interpretation. Maybe they could go after the definition of when open sourcing would benefit the public?

Other possibility is that they claim they spent the non-profut funds prior to going for-profit? It would be dubious to claim damages if the entity was effectively bankrupt prior to for profit creation.
