If Musk's tens of millions in donations were in reliance on the charter and on statements made by sama, Brockman, etc., there's probably a standing argument there. Musk is very different than you or I -- he's a co-founder of the company and was very involved in its early work. I wouldn't guess that standing would be the issue they'd have trouble with (though I haven't read the complaint).
I don't see how being a former co-founder or a donor gives one standing for this. He has no ownership stake. He isn't a director or member of the organization. The thing he claims is a contract he's party to, isn't.

Generally speaking, changing what your company does is just “pivoting”. It’s not clear to me why Elon would having standing for this suit, or why a company changing their direction would be actionable. This would be like suing Google for removing “Don’t be evil” from their mission statement.
If they started selling jelly beans, I would agree with you. But they changed from a non profit to a for profit model and from a open source to a closed source model. If they pivoted their product that would be one thing, but they completely shifted their mission.
Not exactly - they changed from a non-profit funded by donations to a for-profit/non-profit hybrid with the non-profit funded by the for-profit.

It says "will seek to open source technology for the public benefit when applicable" they have open sourced a number of things, Whisper most notably. Nothing about that is a promise to open source everything and they just need to say it wasn't applicable for ChatGPT or DallE because of safety.
I doubt the safety argument will hold up in court. Anything safe enough to allow Microsoft or others access too would be safe enough to release publicly. Our AI overlords are not going to respect an NDA. And for the public safety/disinformation side of things, I think it is safe to say that cat is out of the bag and chasing the horse that has bolted.

#845If OpenAI became a non-profit with this in its charter: “resulting technology will benefit the public and the corporation will seek to open source technology for the public benefit when applicable. The corporation is not organized for the private gain of any person" I don't think it is going to be hard to show that they are doing something very different than what they said they were going to do.
They claim that this is about the end result, but in the meantime, they can license the not-yet-done AI to Microsoft.

I’d offer that Musk hasnt shown any consistent principle motivating his behavior other than gathering power, in the face of stated motivations. So while he may genuinely believe what he is saying, the inherent philosophical conflicts in his consistent narcissistic actions, have poisoned any other possible position to such an extent that he has lost all moral credibility Revealed preferences never lie
He seems to broadly pursue projects he considers helpful to humanity like sustainable energy, the multiplanetary thing and setting up OpenAI. You can interpret people's motivations in different ways but it doesn't look like just power gathering to me. I mean if he was that power hungry you'd expect him to try to monopolize AI for himself rather than make it open.
To be fair, in regards to his actual companies I don’t have much of a complaint, it’s his cult of personality that I can’t stand.
