You could mail order a machine gun until the 1930s and nonviolent felons could buy guns up until the 60s ( violent ones too a few decades before that ). Not much to challenge federally on some of these points until recent history. Also the bill of rights werent fully incorporated upon the states until well past the signing of the Constitution.
