if you sell me something that says it does X on the box, but doesn't actually do X then that's all the purview needed. if they have to prove it by getting into the source code, then all the better. assuming this would be some 3rd party auditing company doing it for them. why? there's a difference of being so bug ridden that your software doesn't work vs just doesn't even attempt to do what the box claims.

Its incredible.
The language is not bureaucratic, its elegant, precise, and clear. Like written by a passionate person who cares about the topic, rather than a government drone.

They can't do it willy nilly, if I'm understanding it correctly. Only as part of an ongoing investigation, along with all the legal clauses and restrictions of running an investigation. And this sort of thing is exactly what I'd expect from an FTC investigation.
I do love the use of "look under the hood", which I imagine is a nod towards Tesla and FSD.

If claims are made, those claims must be verifiable... Same as eg. for medication, snake oil much?

I think they're referring to the discovery process in the lawsuit that you'll be dealing with.
