I was talking about the latter - using section 51 of the constitution to acquire the intellectual property (the Australian Government can make a law to compulsorily acquire property from citizens "for any purpose" but only "on just terms"). Not that I know of, but I think it should be possible because copyrights, patents and trademarks are one of the areas the Federal Govt are constitutionally allowed to make laws about (which is the other test apart from being “on just terms”).
