Criticism is good for a creator. If you can't turn criticism into a force to improve your product, you're doing it wrong. (Granted, baseless criticism doesn't count.) And if they're violating Apple's HIG... Seriously, why? That should be the easiest thing to get right. They've outlined it for you.
Apple's HIG isn't the end of UI design though. Even Apple refuses to blindly follow it. It's a guideline. Not hard and fast rules that must be followed in all cases.
When you're just copying an iOS interface to the Mac, to use an example from that site, that isn't intelligently deciding that you can do one better than the HIG. That's just pointlessly making the app less intuitive.
