In most places the driver isn’t an experimental automated vehicle. Maybe while trying new tech that can apparently fail to see a woman with LIDAR, stick to the damned speed limit? That seems fair to me.

It's hard to square that with someone darting over from a brushy median on the driver's side of the car. Hopefully NTSB will grab the sensor data and sort things out.

A X,000lb car going 38mph takes a certain amount of time and distance to stop, even with a perfect reaction time. If she really did step out in front of the car with less than that distance to spare, than there wasn’t much to be done, sadly.

You aren't kidding about it being standard operating procedure. Almost every time a pedestrian or cyclist is killed in New York City, the police come out and blame anyone but the driver. And then video will turn up afterwards showing that the driver was driving unsafely, and that the fatal accident could have been avoided. Still, no charges are filed. There is data...in the form of a video taken by the car that hit her . You don't need a team of PhDs to watch it and make a judgment call.
