Is ChatGPT Use of Web Content Fair?

If companies can scrape websites and use data from public sites, I dont see how this is any different. Microsoft lost its case with linkedin for data.

I'd say under current law, if you can see it, you can use the data. But laws changed under different judges. If Scotus reverses the microsoft case, then maybe.
