So what happens to their $1T valuations now, given they can't sell the product to consumers, and open-weight models are closing in on competition?

Yeah, it seems like this makes a massive cut into their possible revenue.

There is simply no way to look at Constitutional doctrine pre- and post-Chevron and conclude that the decision put more power in the hands of the President and his administration. It did exactly the opposite.

In effect, it did not. All it said is that the powers enumerated to those executive agencies must be more explicitly laid out by congress. But, that’s just not something that’s going to happen. So, the gap has been filled largely by executive orders.

No, that is not what it said. It said that the power to interpret Congressional statues from first principles rested with the judiciary and not with the executive.

It eliminated the idea of a “gap” that executive agencies (whatever do you mean by “executive orders” in this context?) could be deferred to to fill.

My goodness, this is basic stuff in this Constitutional domain.

If that was a guesstimate on frame rate it's likely off. Regardless of US controls, I can from Australia buy a high quality 50 fps thermal scope with built in 1000m (or ~ 1000 yard) laser range finder from Hangzhou, China. ie. Why lock the stable at 9 fps when out on the open plain 50 fps is already running free.

The US government obviously has no control over what China sends to Australia, so it this case the cat is out of the bag. However I can assure you the limit is still real for US companies: https://oem.flir.com/support/support-center/knowledge-base/a...

Chinese 50 fps thermal cameras and scopes have been about for a while now, they've been supplying the industrial specialist market even longer than the general consumer goods market.

I note the US export control is limited by licence .. which likely means the US high frame rate thermal gear is equally as available in AU as (say) TI DSP chips were when they first iterated that family (ie. restricted by licence but easy to purchase in allied countries if you just sign a form stating you're not supplying them to countries in the Chinese sphere of influence, etc.)

Technically the US government is allowing Anthropic to serve the models to any US citizen, and it's Anthropic who decided that's impossible to comply with and so they pulled the model for everyone. I guess a US business with non-citizen employees could work. A lawsuit would be a hard sell though, because Anthropic themselves argued that the technology is dangerous. Even if many people on HN might think that Anthropic…

This is far from a new challenge though. Another recent example, China has an advantage on cost of labor and manufacturing, and lack of enforcement of IP rights. They can produce for much cheaper than many other countries but it hasn't led to everyone banning trade with them.

What part of China has cheap qualified labor? Skilled engineers nowadays demand between southern and central European prices at the very least.

What type of roles are you considering? Look into their manufacturing, for example. They make all kinds of heavy machineryat costs much lower than US prices, as far as I understand a big contributor is labor costs.

Its also worth noting that st southern and central European labor costs they would still have an advantage over the US.

If this becomes the norm, what incentive does the rest of the world have to keep their markets open to the US? If US companies have a large unfair advantage such that domestic competitors are no longer able to compete, then wouldn't it make sense for governments around the world to ban or tariff US products and services? If I was responsible for national economic policy, I would place this at the top of my non-emerge…

Imagine being Rivian if Tesla gets access, Rocket Lab or Blue Origin others if SpaceX gets access, most of SV if major tech companies get access, ... imagine being a startup.

China has a single leader with absolute power. The irony is that the US is currently getting so much flak because it's leader is trying (and failing, EOs only go so far) to become what Xi Jinpeng is to China. So if you want to put all your eggs in Xi's basket alone, go ahead. But if he has a stroke tomorrow and thinks China would be best off making pool toys, all your eggs will be smashed in one instant.

In a free market you'd have a choice of insurance providers rather than having to take whatever plan your employer offers, and you'd have some idea of what the hospital is going to charge you beforehand rather than receiving random bills for weeks.
