Do we though? It’s an important question about liberty - at what point does a business become so large that it’s not allowed to decide who gets to use it? There was a famous case here in the UK of a cake shop that banned a customer for wanting a cake made for a gay wedding because it was contra the owners’ religious beliefs. That was taken all the way up to the Supreme Court IIRC.
For me the liberty question you raised there isn't so much about whether the business has become large, as whether it's become "infrastructure". Being denied service by a cake shop may very well be distressing and hurtful, but being suddenly denied service by your bank, your mobile phone provider, or even (especially?) by gmail can turn your entire life upside down.

Use caps. DO NOT DO X. works like a charm on codex.
"Don't do that" is one level. It's weak, but it is directive. It often gets ignored.
"DON'T DO THAT" is another. It may have stronger impact, but it's not much better -- the enhanced capitalization probably tokenizes about the same as the previous mixed-case command, and seems to get about the same result. It can feel good to HAMMER THAT OUT when frustrated, but the caps don't really seem to add much value even though our intent may for it to be interpreted as very deliberate shouting.
"Don't do that, fuckface" is another. The addition of an emphatic and profane quip of an insult seems to generally improve compliance, and produce less occurrence of the undesired behavior. No extra caps required.

My NAL guess is that it will go a little like this:
* Candidate makes disparaging post on reddit/HN. * Gets many responses rallying behind him. * Company (if they notice at all) sues him for breach of Non-Disparagement-Agreement. * Candidate makes followup post/edit/comment about being sued for their post. * Gets even more responses rallying behind him.
Result: Company gets $10.000 and even more damage to their image.
(Of course it might discourage some people from making that post to begin with, which would have been the goal. You might never try to enforce the NDA to prevent the above situation. Then it's just a question of: Is the effort to draft the NDA worth the reduction in risk of negative exposure, when you can simply avoid all of it by not providing feedback.)

When you sign up, you must provide legal assurance that no LLM has ever banned you (much like applying for insurance). What do you mean? This is very much true. We are economically compelled to buy food from supermarkets, for instance, because hunting and fishing have become regulated, niche activities. Compared to someone from the 1600s who could scoop a salmon out of the river with a bucket, we are quite oppressed.
