These are rules for States. It has no bearing whatsoever on the GPL. This prevents a country from forcing somebody like Microsoft or Apple to give up their source code for "inspection" in order to access their market. Just because this clause is completely unrelated to the GPL doesn't make the clause okay. It's still shitty because it blocks democratic governance options to have policies that require source release for various situations (such as requiring Open Source for government software use or making policies that software in schools needs to be Open Source etc)
