compared to apple, I would say yes. but it also has a lot to do with the new CEO offsetting strategy I think.

Getting there! Cortana is a nice example how they can perform if there's no legacy.

On the other hand some of the things they do are kind of fscked up. Branding Windows Phone apps Bing, not Bing, Bing.

In addition Xbox Music on Windows Phone is terrible.
