Well, considering an outbreak of destroyed evidence seems to be happening in the courts, with some accountability hopefully it will be an unwritten law. But of course Congress could also get involved.
Should we outlaw executives having business-related phone calls or face-to-face conversations, too?
Or outlaw writing their memos on flashpaper?
Really, their written communications need to be discoverable. And it wouldn't be unreasonable to require at least notes be taken of their phone calls and meetings.
