#13Huh, I'm surprised Canadian courts allow (or allowed?) that. The US won't let you just sue foreign governments in its courts like that.
Not an expert or lawyer, but the US FSIA has an exception for commercial activity carried out by the state in the US, which seems pretty much like the exact scenario here.

ISDS provisions which the US demands in trade deals are designed to allow you to sue foreign governments in court.
