This is certainly a strange thing to have in there, as we've had public discussions about performance before and I assume no one's accused those customers of violating the ToS.

I'll see if I can find someone inside Atlassian to talk about this part of the ToS

(edit: Looks like other users have found similar clauses in other companies, so it seems like it might be standard legalese. Will still see if I can find out more)

Every Atlassian product I've used has had scalability problems. Instead of trying to hide them, they should work on fixing them.

If only there was a product that helped size up work and let teams manage a backlog of features. :D

How bad has your performance to be until you explicitly prohibit people using your service talking about the performance issue?

I‘ll wait until they discontinue the service for a customer because he did not respect this ToS section.
